These terms and conditions ('Terms of Sale') are binding on the individual or legal entity making a reservation ('You/Your') and the temporary accommodation service provider you have booked (the 'Property') named above ('We/Us/Ours').

 

These Terms of Sale concern the provision of temporary accommodation (the 'Reservation') for the Property named on the confirmation page of Your online Reservation and in Your confirmation email (the 'Confirmation'). These Terms of Sale are subject to the jurisdiction of the courts under common law and apply exclusively to all Reservations made at Our Property.

 

By making a Reservation, You agree to be bound by these Terms of Sale and confirm that You are over eighteen (18) years of age and have the legal capacity to make Your Reservation.

 

Reservations

 

Your Reservation establishes a contract between you and us and will be considered final when you have received our confirmation and when we have:

 

 either received payment for the total value of the reservation,

 

 or received a deposit of less than the total value of the reservation as specified at the time of booking,

 

 or  been able to guarantee your reservation by pre-authorizing a credit card for an amount equal to at least the cancellation fees stipulated on your confirmation.

 

 If the amount charged at the time of Booking is less than the total value of the Booking, any remaining balance must be paid either upon Your arrival (check-in), upon Your departure (check-out), or in the form of a deposit(s) charged on the dates specified in Your Confirmation.

 

 When your reservation is confirmed, a reservation number will be sent to you by phone, online, or in your confirmation. This reservation number is required if you wish to cancel or modify your reservation at a later date and is a necessary reference in all your communications with us. Subject to the cancellation conditions stipulated in your confirmation, you do not have the right to cancel.

 Rates

 

The price of the Reservation is based on:

 the number of guests,

 

 the number of nights,

 

 the dates and room types specified in Your Confirmation.

 

 Any additional products or services selected at the time of booking may also be included in the total price of the Reservation.

 

 The total price of the Reservation is expressed in the currency indicated on Your Confirmation and on the screen at the time of payment and includes all taxes applicable on the date of the Reservation, including, without limitation, VAT, sales taxes, and local or special taxes detailed on Your Confirmation.

Pricing Error

 

In the event of a pricing error, We will notify You of such error as soon as possible and, where applicable, We will immediately refund You all payments We have collected for that Reservation. You agree that We shall not be liable for any other expenses incurred by You as a result of such error.

 

Availability

 

In the very rare event that We are unable to provide you with temporary accommodation that matches the description and conditions mentioned in Your Confirmation, We will offer you alternative services. If the price of the alternative services offered is lower than the advertised and prepaid price, the difference will be refunded to You. If the rate applicable to the replacement services is higher than the advertised rate, We will cover the additional costs, provided that the quality and nature of the replacement services remain reasonably comparable to the services offered in the original Reservation.

 

Arrivals and departures

 

Check-in and check-out times are specified in Your Confirmation.

 

 If you wish to arrive outside the hours indicated in your Confirmation, please contact us directly to reconfirm your arrival time.

 

 If your arrival time exceeds the arrival time limit stipulated in your Confirmation, without prior agreement with us, we will not be liable for any costs incurred as a result.

Payments

 

All Reservations must be guaranteed by a valid credit card or other accepted online payment method at the time of booking.

 

 Any deposit payable at the time of booking will be charged at the time of Reservation.

 

 Your reservation may be automatically canceled if your bank declines your card or if there are insufficient funds in your account when the card is preauthorized.

 

 Any deposit payable after the reservation is made but before arrival will be debited in accordance with the dates and payment rules detailed on your confirmation.

 

 Any remaining balance will be invoiced and debited on site before your departure, including any additional products or services consumed during your stay.

 

 PLEASE NOTE - Your credit card details are processed in accordance with PCI-DSS/3DSecure security standards in order to guarantee your reservation by pre-authorizing your credit card and to allow, if necessary, the collection of any deposit or late cancellation penalty, up to the total value of the reservation and in accordance with the payment rules detailed on your confirmation.

 

 If your credit card has been debited before arrival, any charges debited will be deducted from the final balance. If your credit card has been pre-authorized before arrival, we will either debit the pre-authorized amount upon your departure (check-out) or cancel the pre-authorization first before debiting your card for another amount. A pre-authorization is NOT a charge and no amount is debited from your account. However, your bank may choose to reduce the available credit limit on your credit card if it considers a pre-authorization to be a commitment to future expenditure. For this reason, we cancel any pre-authorization electronically with your bank if the amount is not debited upon your departure or if the Reservation is canceled.

 

 

Responsibility

 

We do our best to describe the type of accommodation offered, the location of Our Establishment, its level of comfort and main features, its certification and tourist classification in accordance with current regulations, but We are unable to guarantee that Our services will meet Your expectations in any way. If you have any questions about our services, the location of the accommodation, safety, or hygiene, please contact us directly BEFORE the cancellation deadline and we will do our best to answer them.

 

 We cannot be held liable to You for the non-performance of any of Our obligations hereunder that is not attributable to Us (fraud, misrepresentation, etc.) or that is the result of a force majeure event. In any event, Our liability shall not exceed the amount We have received for Your Reservation.

 

 We strive to exercise all reasonable care and diligence necessary for the proper performance of Our obligations. We cannot be held liable for any indirect damage (including loss of profit, loss of revenue, loss of money, loss of time, missed opportunities, or any other harm or damage) that is not directly caused by Us or that We could not reasonably foresee.

 

 We recommend that you take out appropriate travel insurance. You are liable for any damage, loss, or harm suffered by our establishment as a result of any fault (acts or omissions) or negligence on your part. In such cases, you agree to pay us directly any amount reasonably necessary to repair such damage caused by you.

 

 We reserve the right to cancel your Reservation immediately and without refund if your behavior during your stay ceases to be reasonable and/or gives rise to serious complaints from the staff of our Establishment or from other guests of the establishment.

 

 Protection of Personal Data

 

 Please note that your personal data is necessary for processing your Reservations. This information is stored in our system and transmitted to our Service Providers who are responsible for processing your Reservation. The transmission of your personal data to our service providers is for the sole purpose of enabling us and our service providers to process your reservation. If necessary, our company and our service providers may transmit your data within their group, in all countries where they may operate.

 

 We may also be required to transmit Your personal data, including without limitation Your identity, home address, telephone number, email address, and bank details, to the police or other competent authorities when required by applicable laws and regulations and on the basis of a legitimate request. The following safeguards have been taken by us and our service providers (including eviivo Limited) to ensure an adequate level of protection for your personal data:

 

  •   Your personal data is used for the sole purpose of processing your reservation.

  • Any entity or service provider processing your data outside the European Union must offer an adequate level of protection governed by the standard contractual clauses established by the European Commission in accordance with the General Data Protection Regulation (GDPR).
